An informational summary of the patent renewal rules in place for Italian patents.
Renewal Years
Fees are due both before and after the grant of the patent from the time the patent hits the fourth anniversary of the filing date. From then on, fees are due annually.
Renewal Dates & Payment Windows
The end of the payment window is defined as the end of the month of the anniversary of the filing date. The payment window opens three months before.
Late Payments
For an additional penalty charge of 100€, renewal fees can be paid up to six months after the renewal date.
European Applications
As usual, if the original application was made through the European Patent Office (EPO), fees are not due to each of the country offices until after grant. During the application stage, fees are paid to the EPO only.
